Washington State Housing Legislation: Governor Ferguson Signs Landmark Bills to Tackle the Housing Crisis

Navigating the complexities of real estate development and urban planning in the Pacific Northwest requires keeping a close eye on legislative shifts. Over the past decade advising developers, property investors, and municipalities, I have rarely seen a legislative package as comprehensive as the one recently enacted in Washington. Governor Bob Ferguson signed a sweeping slate of seven housing bills at a ceremony in Everett, cementing a bold agenda designed to accelerate real estate development, streamline permitting, and directly tackle affordability across the state.

For industry professionals, investors, and community leaders, understanding these new statutes is essential. From commercial conversions to rural zoning adjustments, these policies reshape the state’s residential and commercial landscape.

Transforming Commercial and Mixed-Use Zones: Senate Bill 6026

The centerpiece of Governor Ferguson’s legislative package is Senate Bill 6026, sponsored by Senator Emily Alvarado. Passing with strong bipartisan majorities (35–14 in the Senate and 69–27 in the House), this statute targets one of the most stubborn bottlenecks in urban planning: land availability and zoning rigidity.

Under the new law, local jurisdictions with populations exceeding 30,000 must officially allow residential housing in areas zoned for commercial or mixed-use. For developers and commercial real estate investment trusts (REITs), this unlocks immense potential. Vacant strip malls, shuttered big-box retail spaces, and underutilized parking lots can now be seamlessly transitioned into multifamily residential projects.

Furthermore, the legislation addresses the economic friction caused by mandatory ground-floor retail requirements. It limits local governments from mandating ground-floor commercial space in more than 40% of their total commercial or mixed-use acreage. Crucially, it completely exempts affordable housing projects from these mandates. By lifting these arbitrary requirements, the state reduces significant financing barriers and allows market fundamentals to dictate where commercial storefronts genuinely make economic sense.

Streamlining Permitting and Expanding Affordable Housing Options

In addition to SB 6026, the governor enacted several other critical measures designed to modernize development standards and diversify housing stock:

House Bill 2266 (STEP Housing Standards): Sponsored by Representative Strom Peterson, this bill establishes uniform statewide permitting standards for permanent supportive housing, transitional housing, and emergency housing. By creating predictability, it minimizes costly delays for shelter and supportive housing development.
House Bill 1345 (Rural ADUs): Sponsored by Representative Sam Low, this statute authorizes counties to permit landowners in rural communities to build detached accessory dwelling units. Alongside generational living benefits, the bill establishes clear environmental guardrails, including strict water use standards.
Senate Bill 6237 (Flood Risk Disclosures): Sponsored by Senator Jessica Bateman, this measure requires landlords to formally disclose property flood risks to tenants. Bringing Washington in line with states like California, Oregon, and Texas, this requirement protects renters and informs critical insurance and risk-management decisions.
Senate Bill 6027 (Affordable Housing Funding Flexibility): Also sponsored by Senator Alvarado, this statute grants local governments greater discretion in utilizing tax revenues earmarked for affordable housing while safeguarding state contractors against federal policy volatility.
House Bill 2418 (Project Review Act Updates): Sponsored by Representative Davina Duerr, this bill streamlines the Local Project Review Act by imposing strict review timelines on special purpose and public utility districts, cutting down administrative lag for builders.
House Bill 1974 (Land Banking Authorities): Sponsored by Representative Natasha Hill, this legislation accelerates the acquisition of abandoned or underutilized properties through local land banks, preserving vital parcels for future affordable development.

A Comprehensive Administrative Push

Governor Ferguson’s legislative victories build upon a proactive executive strategy launched on his first day in office. By signing an executive order directing state agencies to audit and eliminate redundant regulations impacting construction, the administration has signaled a clear pro-development stance. Combined with a historic $244 million supplemental budget investment in housing and the formation of a cabinet-level Department of Housing Task Force, Washington is systematically dismantling institutional hurdles.

For developers, landowners, and investors evaluating current opportunities, these reforms represent a generational shift toward a more predictable, flexible, and responsive housing market.
